On April 22, 2021, the Federal Council also approved the Fourth Civil Protection Act (Federal Emergency Brake).
In the course of this, the number of children's sick days for employees with statutory insurance will be increased again. In 2021, each parent will now have 30 instead of the previous 20 children's sick days per child (60 instead of 40 days for single parents). The entire number of children's sick days may also be applied to closings.
In total, employees with statutory insurance are entitled to no more than 90 working days, and insured single parents for no more than 130 working days.
This regulation comes into effect retrospectively on January 5, 2021. Eligible are working parents (with state health insurance) who are entitled to child sickness benefit themselves and whose child is under twelve, provided that there is no other person in the household who can look after the child.
For privately insured parents and parents entitled to subsidies, the law provides for a claim for compensation in accordance with Section 56 (1a) of the Infection Protection Act (IfSG).
